Infrastructure Bill Ends ERC Early

Yesterday, Biden signed the new Infrastructure bill into law. A small sentence in the bill changes the end date for Employee Retention Credits from Jan 1, 2022 to a retroactive Oct 1, 2021, which means, if you have claimed ERC on any Q4 payroll, you've now underpaid your payroll taxes and need to get those paid as soon as possible to avoid late fees.

This payroll tax credit has been an amazing help to many businesses, but it's also been a wild ride of revisions, updates, extensions and now retroactive cancellation. We love that this program helped many small businesses and hate to see the support end early, but not sad to be done dealing with the never-ending rules/forms/amendments that came with it.

NOTE: This change does NOT apply to anyone who is considered a "Recovery Startup Business"; ERC is still allowed for Q4 for eligible businesses that started after February 15th, 2020 (and have sales under $1 million per year).
CONTACT US IF YOU HAVE CLAIMED Q4 ERC ON PAYROLL
If you have claimed ERC on payroll dates between October 1 and now, please contact your accountant right away. We will need to adjust that in your payroll system and then there will be payroll taxes to pay.

If you're doing any future paychecks do NOT list ERC hours/wages! You should edit each employee and uncheck the box next to "Employee Retention Credit Regular Hours."

TAX PLANNING TIME!

Year End is approaching fast. We would love to discuss your specific situation and advise on some year end planning tips including how to take advantage of the new election to deduct state income tax as a business expense (for partnerships and corporations in MN).

It's a great time to get your bookkeeping up to date and email your Fox Tax accountant to set up a time to review how 2021 is going and what you need to do before year end to take advantage of this and other tax savings opportunities.
